Terms and Conditions
1. Prices/Orders
1.1 Prices are based on current web pricing. Pricing is set at web order checkout and confirmed though Versa order acknowledgement. All orders are considered accepted and firm at order acknowledgement.
1.2 Item prices do not include freight, federal, state or local taxes or any other governmental charges or export duties and or fees.
1.2.1 All freight and freight related charges will be included in the total amount due and will be shown as “Shipping and Handling”
1.2.2 All domestic shipments may be subject to state taxes and will be included in the total amount due. These charges will be shown as “Taxes”.
1.2.3 All international shipments taxes and duties are not charged and are the responsibility of the purchaser.
2. Terms of Payment
2.1 Available payment types will be listed at time of order checkout.
2.2 Funds will be authorized at time of order checkout against the chosen payment type. Final settlement will be completed at time of shipment.
3. Freight
3.1 All orders are shipped FOB, Paramus, New Jersey, USA. Freight company is responsible for all issues after shipment such as loss, damage and or delay.
3.2 All freight costs are paid by purchaser and charges are included at order checkout.
3.3 All export fees and related costs are the responsibility of the purchaser.
3.4 Delivery of materials will be by common carrier and shall be considered delivered to purchaser at shipment for Versa. Claim for loss or damaged materials in transit shall be filed by purchaser directly with the carrier.
4. Deliveries/Shipment Lead Time
4.1 All current lead times are listed by item at order checkout. Lead times given at order checkout are estimated.
4.2 Final delivery schedule date is given at acknowledgement of purchase order by Versa. Purchaser would receive order acknowledgement within one working day of order placement.
4.3 Lead times are given by item at order placement. In the case of a multiple item order, Versa will acknowledge one date for complete order. No partial shipments.
4.4 Lead time given by Versa at acknowledgement will be adhered to with the best effort of Versa but are not guaranteed. Versa will not be responsible for delays in delivery or failure to deliver due to causes beyond its control, including without limitations, act of God, acts of Purchaser, fire, flood, accidents, riots, strikes, transportation delays, labor or material shortages or any other causes beyond its control.
5. Changes/Cancellation
5.1 All released/acknowledged orders are considered firm and not subject to change or cancellation. If acknowledged ship schedule is longer than the checkout estimate, purchaser has the opportunity to cancel order at no cost. If purchaser finds acknowledge schedule unacceptable, purchaser has one working day after receipt of order acknowledgement to advise Versa in writing to receive full credit. If no response to acknowledged schedule is received within the one working day, Versa will consider order firm.
5.2 Orders placed online with Versa that do not meet the schedule exception above cannot be canceled or changed, except with written approval of Versa. If accepted by Versa, orders may be subject to 100% cancellation charge.
6. Returns
6.1 Requests for return to be made in writing to Versa and must include the reason for the return. All returns subject to 25% restock charge. Shipping and handling charges are not subject to credit.
6.2 Upon receipt of written notice authorizing return of products and a return goods authorization (RGA) number, ship to Versa prepaid. No “collect” shipments will be accepted.
6.3 Returned items are subject to Versa’s inspection. Versa will notify returnee of any products, which it finds are not in accordance with 6.5 and will hold these products for thirty days for shipping instructions before disposing of them as Versa sees fit.
6.4 Returned item credit would be sent to original form of order payment.
6.5 Except for Versa Fault Returns (6.6), to be considered for return, products must meet the following requirements:
6.5.1 They must be unused and packed in their original, unopened containers.
6.5.2 They must be returned within 90 days from the shipping date.
6.5.3 They must not include parts, repair kits or subassemblies.
6.6 Versa Fault Returns. If Versa shipped incorrect items and Versa is at fault, a re-shipment will be made. Products shipped in error would be returned to Versa at Versa’s expense. Versa will pay freight charges in shipping replacement products.
7. Design
7.1 Versa Products Company reserves the right to modify, change or obsolete any product without notice.
8. Warranty and Limitations
8.1 Products sold by Versa are warranted to be free from defective material and workmanship for a period of ten years from date of shipment, provided said items are used in accordance with Versa specifications. Versa’s liability pursuant to that warranty is limited to the replacement of the Versa product proved to be defective provided the allegedly defective product is returned to Versa.
8.2 Versa provides no other warranties, expressed or implied, except as sated above. There are no implied warranties of merchantability or fitness for a particular purpose. Versa’s liability for breach of warranty as herein stated is the only and exclusive remedy and in no event shall Versa be responsible or liable for incidental or consequential damages.
Versa Products Company, Inc. reserves the right to change Terms and Conditions at any time without notice, and reserves the right to interpret, clarify, and apply these policies as it sees fit.
